Neighbors tree is a big pain-what to do?
Hey folks! I live near the beach and have a neighbor who is a bit of a pain. Well, not the actual neighbor because they rent. But the owner of the rental has a huge tree which is like 1 foot from my fence-I think it is a liquid amber or silver maple. The tree blocks all the morning sun on my front yard, and is probably 40 feet high or so. When I bot my house limbs were even hanging over my fence, and one knocked off a run of rain gutter on my roof. The tree is poorly placed, was there long before he had bot the house, or I. It is breaking up his driveway. It drops a ton of leaves in my yard each year in Fall, even though I have cut everything off from my fence line up. The tree is imbalanced now because I cut it like a wall up from my fence. Being the kind person I am, I even told the owner I would PAY to have the tree removed, and he declined. Is there a legal remedy, or a stealth way of killing it? I tried copper nails last year but have yet to see results. Is court an option?
What I would do first is to get your hands on the land lines. Try to find out exactly where the property lines fall if you find out that it is mostly on your property I would def take some kind of action to have it removed. Suggest to the owner of the property that he put a tree on the other side of the prop because it is really bothersome to you...ask him to find a way to keep up with the maintance of the tree on you property. Also try asking him what he feels is a good compromise. You dont want to go and just cut it down or you can get into some serious legal issues. If nothing resolves this then last resort try to take him to civil court to have it removed. Good Luck and I hope you get to enjoy the sun soon.
